1. Acceptance of Terms
Welcome to NoteCrunch.
These Terms of Service ("Terms") govern your access to and use of the NoteCrunch mobile application, website, and related services (collectively, the "Service").
The Service is operated by Mohamed Allag, France ("NoteCrunch", "we", "us", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service.

- AI tutoring features
- Learning assistance tools
- Other educational features
We may modify, add, suspend, or remove features at any time.
4. User Accounts
To use certain features, you may be required to create an account through:
- Apple Sign In
- Google Sign In
You are responsible for maintaining the security of your account.
You are responsible for all activities that occur under your account.
You agree to provide accurate information and keep your account information up to date.
5. User Content
"User Content" includes any content uploaded, submitted, stored, or generated through the Service, including:
- Documents
- Notes
- Course materials
- Educational resources
- AI-generated outputs
You retain ownership of your User Content.
By using the Service, you grant NoteCrunch a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and analyze your User Content solely for the purpose of operating, maintaining, improving, and providing the Service.
This license ends when your content is deleted from our systems, except where retention is required by law.
6. Content Responsibilities
You are solely responsible for the content you upload.
You represent and warrant that:
- You have the necessary rights to upload the content.
- Your content does not violate applicable laws.
- Your content does not infringe intellectual property rights of third parties.
You must not upload content that:
- Is unlawful
- Is fraudulent
- Is defamatory
- Contains malware or malicious code
- Violates privacy rights
- Infringes copyrights, trademarks, or other rights
We reserve the right to remove content that violates these Terms.
7. Artificial Intelligence Disclaimer
The Service uses artificial intelligence technologies provided by third-party providers.
AI-generated content may contain inaccuracies, omissions, outdated information, or errors.
The Service is provided as an educational aid only.
You are solely responsible for verifying any information generated through the Service before relying upon it.
We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated output.
8. Academic Integrity
NoteCrunch is intended to support learning and revision.
Users remain solely responsible for complying with the academic integrity policies of their school, university, examination board, or educational institution.
We do not endorse cheating, plagiarism, or academic misconduct.
We are not responsible for any academic consequences resulting from your use of the Service.
9. Subscriptions and Payments
Certain features require a paid subscription.
Subscriptions are processed through Apple In-App Purchases and managed through RevenueCat.
Pricing, billing periods, and available plans may change from time to time.
Unless otherwise stated, subscriptions automatically renew until canceled.
You may manage or cancel your subscription through your Apple account settings.
10. Refunds
Payments are processed by Apple.
Refund requests are governed by Apple's policies and procedures.
We do not directly issue refunds for purchases processed through Apple.
11. Prohibited Uses
You agree not to:
- Reverse engineer the Service
- Attempt unauthorized access to systems
- Circumvent usage limits
- Interfere with Service operation
- Upload malicious software
- Use the Service for unlawful purposes
- Use automated methods to abuse the Service
- Resell access to the Service without authorization
11A. Fair Use Policy
To ensure reliable service for all users and maintain the sustainability of the platform, NoteCrunch operates under a Fair Use Policy.
Subscriptions are intended for reasonable personal educational use.
While NoteCrunch does not impose fixed limits on document storage, we reserve the right to monitor usage patterns and take action where use is excessive, abusive, automated, or inconsistent with normal individual educational use.
Examples of prohibited excessive use may include:
- Uploading unusually large volumes of content unrelated to personal study purposes
- Using automated scripts, bots, or other automated systems to interact with the Service
- Sharing accounts with multiple individuals
- Attempting to resell, redistribute, or provide access to the Service to third parties
- Generating content at volumes that materially impact the stability, availability, or costs of the Service
- Circumventing technical safeguards, usage controls, or security measures
Where we reasonably determine that usage violates this Fair Use Policy, we may:
- Temporarily limit access to certain features
- Apply reasonable rate limits
- Request additional verification of usage
- Suspend or terminate affected accounts
We will make reasonable efforts to apply this policy fairly and proportionately.
Nothing in this policy shall be interpreted as granting unlimited access to computational resources or processing capacity.
The purpose of this Fair Use Policy is to protect the quality, reliability, and availability of the Service for all users.
12. Intellectual Property
The Service, including its software, branding, design, logos, interfaces, and underlying technology, is owned by NoteCrunch or its licensors and is protected by applicable intellectual property laws.

- We are required to do so by law

You may stop using the Service at any time and may delete your account through the application.

We strive to maintain Service availability but do not guarantee uninterrupted access.
The Service may be unavailable due to:

- Technical issues
- Security incidents
- Third-party service outages
- Circumstances beyond our control
15. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE."
We disclaim all warranties, express or implied, including warranties of:

Our total liability for any claim arising from the Service shall not exceed the amount paid by you to NoteCrunch during the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.
17. Indemnification
You agree to defend, indemnify, and hold harmless NoteCrunch and its owner from any claims, damages, liabilities, losses, and expenses arising out of:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of applicable laws or third-party rights

Your use of the Service is also governed by our Privacy Policy.
19. Changes to These Terms
We may modify these Terms from time to time.
Updated versions will be published within the Service or on our website.
Continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.
20. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of France, without regard to conflict of law principles.
